Terms of service

1. general

These general terms and conditions (GTC) regulate all legal relationships between Pickleball Corner (seller) and its customers (buyer) concluded purchase contracts in the online store (www.pickleballcorner.ch). These terms and conditions conflicting provisions of the buyer are hereby expressly excluded.

2. contracting party

In case of a contract conclusion, the contract is concluded with:

The seller can be reached by mail contact@courtpropickleball.com. Orders, inquiries, complaints and other declarations of intent are to be sent to this address.

3. offer and delivery

The offer can be seen on the website www.courtpropickleball.com and is non-binding. Product information is mainly for illustrative purposes and is not binding. Price and product range changes as well as technical changes are reserved. The offers are valid only as long as they are visible on the website and while stocks last.

In the online store, the buyer submits a legally binding offer to conclude a contract by sending his order and simultaneous acceptance of these terms and conditions. The contract is concluded at the time when the buyer receives an order confirmation from the seller by e-mail. In the online store, the delivery method and the delivery costs are shown.

Information on availability and delivery times are not binding. If an item is not available in stock, the buyer will be informed as soon as possible when the delivery can be expected. The seller is not liable for delivery delays caused by manufacturing companies or third parties. All information on delivery times is therefore without guarantee and may change at any time. Delivery is at the risk and expense of the buyer.

4. prices and payment

Prices are quoted in Swiss Francs (CHF). Published prices and conditions are subject to change.

The payment of the ordered goods is made in advance, either by credit card, Paypal or prepayment. For online payments, the value of the goods will be charged on the day the order is received. The seller reserves the right to exclude buyers from individual payment options without giving reasons. Invoices are payable within 20 days of receipt. The seller reserves the right to charge reminder fees of at least CHF 20.- and further collection fees after the second reminder. The assignment to a collection agency remains reserved.

The delivered goods remain the property of the seller until full payment. The Seller shall be entitled to make a corresponding entry in the retention of title register. If the Buyer is in default of payment of the purchase price, the Seller shall be entitled, among other things, to withdraw from the contract and to repossess the goods.

5 Warranty and liability

Complaints due to defects or due to incomplete or incorrect delivery must be notified to the Seller in writing immediately, at the latest 14 days after the date of delivery. Hidden defects must be reported to the Seller in writing immediately, but no later than 14 days after discovery. If the buyer fails to notify the seller in time, his claims shall expire. After return of the rejected goods, the buyer will receive a replacement delivery if there is a defect. If no replacement delivery is possible, the seller will refund the payment made. In addition, any claim for reduction, rescission or damages for consequential harm caused by a defect shall be excluded to the extent permitted by law.

The buyer forfeits any rights for defects in case of improper use of the goods. Defects resulting from normal wear and tear and as a result of improper handling or damage by the buyer or third parties, as well as defects caused by external circumstances (improper storage, frost, heat, humidity, incorrect storage, etc.), do not entitle the buyer to withdraw from the contract or to replace the goods. The seller assumes no liability for this. Returned goods are at the expense and risk of the buyer. The products are to be packed professionally in the original packaging. If the Seller cannot determine any defects covered by the warranty or covered by the manufacturer’s warranty, the Seller may charge the Buyer for the cost of inspecting and shipping the goods.

Other claims of the Buyer – irrespective of the legal ground – are excluded to the extent permitted by law. The Vendor, its auxiliary persons and any vicarious agents shall not be liable for any damage that has not occurred to the goods themselves, in particular not for consequential damages, loss of profit or other financial losses of the Buyer. Any liability of the Seller in connection with the offer (in particular incorrect illustrations, texts and prices) and the delivery is excluded to the extent permitted by law.

6. cancellation, right of return and right of revocation of the buyer

Orders of the buyer are binding and the customer is obliged to accept the service. Subsequent changes at the request of the customer are possible at the discretion of the seller. The buyer has the right to return the goods within 14 days of receipt and to cancel the contract. The right of return can only be exercised with legal effect if the goods are returned unused, undamaged, complete and in their original packaging. Upon receipt of the goods returned in the described condition, the Seller shall reimburse the Buyer for the value of the goods. The goods shall be returned at the expense and risk of the Buyer.

7. copyrights

All texts, images, graphics, video and animation files are subject to copyright and other laws for the protection of intellectual property. They may not be copied, changed or used on other websites without the consent of the seller.

8. data protection

The current version of the Seller’s data protection statement, which is available at www.courtpropickleball.com, shall apply.

The Vendor may send the Customer information about other products or services of the Vendor (e.g. in the form of a newsletter or by letter). If the Customer no longer wishes to receive such communications from the Seller, the Customer may unsubscribe at any time by sending an e-mail to contact@courtpropickleball.com.

9 Applicable law and place of jurisdiction

The seller expressly reserves the right to amend these terms and conditions at any time and to apply them immediately.

If any provision of these Terms and Conditions is found to be illegal, void or unenforceable, such provision shall nevertheless be enforceable to the fullest extent permitted by law and the unenforceable portion shall be deemed severed from these Terms and Conditions, and such determination shall not affect the validity and enforceability of any remaining provisions.

All contracts entered into with Seller shall be governed by Swiss law, excluding the substantive rules of conflict of laws and the United Nations Convention on Contracts for the International Sale of Goods (CISG). In the case of orders placed by private individuals for private use, the place of jurisdiction shall be governed by the consumer protection provisions. In all other cases, Zurich is the exclusive place of jurisdiction.
